The OSPville Decidim platform facilitates democratic participation under French law, ensuring user data protection, content moderation, and proper conduct. By using the platform, users agree to the terms governing registration, participation, and intellectual property.

Preamble

OSPville Decidim (hereinafter referred to as the "Platform") is a digital space designed to foster democratic participation and collective decision-making within the OSPville community. By accessing or using this Platform, users agree to abide by these Terms of Service (hereinafter referred to as the "Terms"). These Terms are governed by French law.

1. Definitions

- User: Any individual who accesses, registers, or uses the Platform in any way.

- Platform Administrator: The team responsible for managing and maintaining the Platform.

- Content: Any text, image, video, document, or other materials uploaded or shared on the Platform by Users.

- Decidim: The open-source digital platform framework used for participatory democracy that powers OSPville.

2. Acceptance of Terms

By using the Platform, Users confirm that they have read, understood, and accepted these Terms. Users who do not agree with any of the provisions of these Terms must refrain from using the Platform.

3. User Registration

To fully participate in certain activities (e.g., voting, proposal submissions), Users must create an account. Registration requires the following:

- A valid email address.

- The creation of a unique username.

- Acceptance of these Terms.

Users must provide accurate, up-to-date information during the registration process. The Platform reserves the right to suspend or delete accounts with false or incomplete information.

4. User Responsibilities

Users are responsible for:

- Ensuring that their use of the Platform complies with all applicable laws and regulations, including but not limited to French legislation on data protection (GDPR) and online content.

- Maintaining the confidentiality of their account credentials.

- Refraining from posting any illegal, harmful, defamatory, or otherwise inappropriate content.

- Respecting the rights of other Users, including privacy and intellectual property rights.

Users must not:

- Attempt to interfere with the proper functioning of the Platform.

- Engage in any activities that disrupt or harm the experience of other Users.

- Upload any content containing malware, viruses, or harmful code.

5. User Content

Users retain ownership of any Content they submit to the Platform. However, by posting Content, Users grant the Platform a non-exclusive, royalty-free, worldwide license to use, modify, and distribute this Content for the purposes of the Platform’s operation.

The Platform reserves the right to remove any Content that violates these Terms or applicable laws, without prior notice.

6. Data Privacy and Protection

The Platform is committed to protecting Users' personal data in compliance with the General Data Protection Regulation (GDPR) and French data protection laws (Loi Informatique et Libertés).

- Users' personal data will only be used for the purposes of managing participation, communication, and improving the Platform.

7. Moderation

The Platform Administrator reserves the right to monitor and moderate the interactions on the Platform. Participation in proposals, discussions, or voting is open to all registered Users, provided that they meet the eligibility criteria for each specific process. Each User has a responsibility to participate in good faith, and any attempt to manipulate results (e.g., multiple voting, fraud) is strictly prohibited.

9. Intellectual Property

All intellectual property rights related to the Platform, including the software, design, and structure, are owned by the Platform or its licensors. Users may not reproduce, distribute, or use any part of the Platform for commercial purposes without prior written consent from the Platform Administrator.

10. Limitation of Liability

The Platform is provided "as is" without warranties of any kind, either express or implied. The Platform Administrator will not be liable for any damages or losses, whether direct or indirect, arising from:

- Use of the Platform.

- Any technical issues, including service interruptions or data loss.

- User-generated Content, including offensive or illegal materials posted by others.

11. Service Availability

The Platform aims to provide continuous and uninterrupted access but does not guarantee 100% availability. Maintenance, updates, or technical issues may result in temporary downtime. Users will be informed in advance when possible.

12. Modifications to Terms

The Platform reserves the right to modify these Terms at any time. Any changes will be communicated to Users by email or through an announcement on the Platform. Continued use of the Platform after such modifications indicates acceptance of the updated Terms.

13. Termination of Account

Users can request the termination of their account at any time by contacting the Platform Administrator. The Platform reserves the right to terminate or suspend a User's account for violations of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute arising in connection with the use of the Platform will be subject to the exclusive jurisdiction of the courts of France.
